End User License Agreement

This End User License Agreement ("EULA") is a binding agreement between you and TNAADO Inc ("TNAADO," "we," "us") and governs your use of the Mr. Indecisive mobile application, including all updates, content, and services it provides ("the app"). By downloading, installing, or using the app, you agree to this EULA. If you do not agree, do not download or use the app.
License grant
Subject to your compliance with this EULA, TNAADO grants you a limited, non-exclusive, non-transferable, revocable license to download and use one copy of the app on any Apple-branded device that you own or control, solely for your personal, non-commercial use, in accordance with the Apple Media Services Terms and Conditions and the Usage Rules in the App Store Terms of Service.
License restrictions
You may not, and may not permit anyone else to:
- Copy, modify, adapt, translate, or create derivative works of the app, except as expressly permitted by law.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the app, except to the extent applicable law expressly prohibits this restriction.
- Rent, lease, lend, sell, sublicense, distribute, or otherwise transfer the app to any third party.
- Remove, alter, or obscure any proprietary notices in the app.
- Use the app to develop a competing product, or use any automated means to access, scrape, or harvest data or content from the app.
- Use the app in any unlawful manner, for any unlawful purpose, or in any way that disrupts, overloads, or impairs the app or its systems.
The app is licensed, not sold, to you. TNAADO and its licensors retain all right, title, and interest in and to the app, including all intellectual property rights.
User-generated content
The app lets you post user-generated content, including video clips, captions, and venue or place information ("Your Content"). You are solely responsible for Your Content and the consequences of posting it. You represent that you own Your Content or have all rights and licenses needed to post it, and that it does not infringe anyone else's rights.
Zero tolerance for objectionable content and abusive users. There is no tolerance for objectionable, abusive, or illegal content or behavior on Mr. Indecisive. Prohibited content includes, without limitation: harassment, bullying, threats, hate speech, sexual or pornographic material, content that exploits or endangers minors, violence or incitement, illegal activity, spam, and impersonation. You may not abuse, harass, or threaten other users.
We provide tools to flag and report objectionable content and to block abusive users directly inside the app. We review reports and act on objectionable content within 24 hours by removing the content and, where warranted, ejecting the user who posted it. We reserve the right, in our sole discretion, to remove any content and to suspend or permanently terminate the account of any user who violates this EULA, with or without notice.
By posting Your Content, you grant TNAADO a worldwide, non-exclusive, royalty-free license to host, store, reproduce, encode, display, and distribute Your Content for the purpose of operating, promoting, and improving the app. You retain ownership of Your Content; this license ends when you delete the content or your account, except for copies in routine backups or where retention is legally required.
Auto-renewable subscriptions
The app offers optional auto-renewable subscriptions that unlock additional restaurant recommendations:
- Plus — $2.99 / month.
- Unlimited — $5.49 / month.
New subscribers may be offered a 7-day free trial. If you start a trial and do not cancel at least 24 hours before it ends, it automatically converts to a paid subscription, and any unused portion of the trial is forfeited.
Subscriptions are sold and managed by Apple through your Apple ID and are subject to Apple's terms. Payment is charged to your Apple ID at confirmation of purchase. Subscriptions auto-renew at the then-current price, and your Apple ID is charged for renewal within 24 hours before the end of the current period, unless you cancel beforehand. You can manage or cancel your subscription, or turn off auto-renewal, at any time in Settings → [your name] → Subscriptions on your iPhone — cancel at least 24 hours before the end of the current period to avoid the next charge. Refunds, where applicable, are handled by Apple.
Disclaimers
The app is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. TNAADO does not warrant that the app will be uninterrupted, error-free, or secure. Recommendations, place data, and venue information are provided for convenience and may be inaccurate, incomplete, or out of date; you are responsible for verifying details such as hours, location, and availability before relying on them.
Limitation of liability
To the maximum extent permitted by law, TNAADO and its officers, employees, and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or profits, arising from or related to your use of the app. To the maximum extent permitted by law, our total liability for any claim relating to the app will not exceed the greater of the amount you paid us in the twelve months before the claim or CAD $50.
Termination
This EULA is effective until terminated. Your rights under this EULA terminate automatically, without notice, if you fail to comply with any of its terms. You may stop using the app and delete your account at any time. We may suspend or terminate your access if you violate this EULA or to protect the app and its users. Upon termination, you must stop all use of the app and delete all copies.
Apple-specific terms
This EULA is between you and TNAADO only, and not with Apple. Apple is not responsible for the app or its content. Apple has no obligation to furnish any maintenance or support services for the app. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the app. Apple is not responsible for addressing any claims relating to the app, including product liability, legal or regulatory compliance, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of this EULA and, upon your acceptance, will have the right to enforce it against you.
Governing law
This EULA is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in Toronto, Ontario, Canada.
Changes to this EULA
We may update this EULA from time to time. When we do, we will revise the "Last updated" date above. Continued use of the app after changes take effect constitutes acceptance of the updated EULA.
